Cancellation policy (right of withdrawal)

The following right of withdrawal applies only to consumers. Entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) have no statutory right of withdrawal.

Right of withdrawal

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity.

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Hannes Sauerbaum, Knoevenagelweg 11, 30165 Hannover, Germany, email: [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

Expiry of the right of withdrawal for digital content

The right of withdrawal expires for a contract for digital content which you receive by download and which is not supplied on a tangible medium such as a USB stick or DVD if the contract obliges you to pay a price and if you

• have given your express consent that we begin performance of the contract before the withdrawal period has expired, and
• have acknowledged that you thereby lose your right of withdrawal, and
• we have provided you, on a durable medium, with a confirmation of the contract within a reasonable time after the conclusion of the contract, and at the latest when the digital content is supplied, reproducing the content of the contract and stating that you gave your express consent before performance that we begin performance before the withdrawal period has expired, and acknowledged that you thereby lose your right of withdrawal once performance begins.

Orbit is supplied as desktop software that you download and install locally. The consents above are requested at purchase in the desktop app via checkboxes and must be actively confirmed before the download or license unlock takes place. You receive the contract confirmation, including the consents given, by email.
